In February of 2014 a federal civil suit, known as Sokolow v.Palestinian Authority was heard by a New York jury in the U.S. District Court Room of Judge George Daniels. The 10 American Families who were the plaintiffs either suffered injuries themselves or lost loved ones in terrorist attacks. The plaintiffs sought relief through a civil remedy provision in the Anti-Terrorism Act and were able to convince the jury that the Palestinian Authority (PA) funded terrorist activities that led to the maiming and deaths of the plaintiffs or their loved ones. A February 2014 jury verdict resulted in a judgment of $655 million in civil damages to be paid to the 10 families. The PA is currently appealing the verdict.
Often, a defendant who has lost their case after the trial phase is required to post a substantial bond while navigating the appeal process. The PA has asked the court for relief on these payments claiming the possibility of becoming bankrupt. President Obama's State Department has taken the unusual step of directing the U.S. Deputy of the State Department, Mr. Antony Blinken, to urge Judge Daniel to be lenient with the PA as to the amount of money they need to post. Obama had Blinken argue that bond payments would "add a new destabilizing feature to region."
On Monday, August 17th, Judge Daniels said that he gave "serious consideration" to the State Department's arguments to go easy on the PA. Judge Daniels weighed in sparingly for the defendants and ordered the PA to post a mere $10 million bond during the appeal process and add an additional $1 million monthly.
What disturbs you more? A president of the United States siding with terrorists? Or, a terrorist regime, which has received over $25 billion in financial aid from the U.S.A. and other countries over the past two decades, crying poverty? Has the $25 billion helped the Palestinian people or helped to bring about regional stability? The $25 billion given to the PA has not been used to promote a Palestinian democracy or provide adequate social services to the Palestinian people. For years the monies have been mismanaged and the EU and USA have not held PA leaders accountable. It is no secret that funds have either ended up in PA leaders' Swiss bank accounts or used to support terrorism. The PA currently spends $60 million a year to pay "salaries" to offenders in prison who have been convicted of murder or other terroristic activities. The PA is not a cash poor organization as claimed by President Obama's State Department. In fact, the PA concealed from the court its "Palestinian Investment Fund." The fund's portfolio had a value of $782.8 million at the close of 2012.
In summary, the PA is awash in money that is used for terrorism and to enrich its leadership. It is inexplicable and inexcusable that a United States President would choose to approach a Federal District Court to advocate for foreign terrorists rather than expedite the statutory award due to American citizens who are victims of terrorism. This week AFSI is partnering with NORPAC and encouraging our membership and friends to participate in the "Call of the Day" to a specific locally elected federal official. When you call, please let the official's office know that you resolutely disapprove of the Iran Deal, more formally called the Joint Comprehensive Plan of Action (JCPOA). Today or tomorrow please place a call to Senator Richard Blumenthal's office, (202) 224-2823 and let his staff know that it is critical that we override the president's promised veto of H.R.1191 - Iran Nuclear Agreement Review Act of 2015. Though the staff will ask you for your name and zip code, you do not need to reside in Connecticut to make this important call. We also encourage you to email the senator's Legislative Director, Ethan Saxon. Mr. Saxon's email address is: ethan_saxon@blumenthal.senate.gov. Some of the talking points you may wish to mention about the deal are: - The immediate release of sanctions instead of Iran earning incremental sanctions relief after demonstrated compliance
- Iran automatically receives $150 Billion to further fund terrorism
- No provision for anytime-anywhere challenge inspections
- US hostages remain in Iran
- The Fordow enrichment facility remains operational and Iran keeps its centrifuges
- It does not prevent Iran from continuing its terrorist activities through its proxy armies in Syria, Yemen, and elsewhere
- The bulk of Iran's programs of weapons of mass destruction remains in place
- This deal has fewer safeguards than the failed deal we made with North Korea, which allowed North Korea to develop an atomic bomb and ballistic missiles. Note, Wendy Sherman, who was at the table during our negotiations with North Korea has once again failed to protect the United States from the proliferation of nuclear weapons by people who are our sworn enemies.
- The deal effectively guts the Nuclear Non-Proliferation Treaty and will lead to
